Artikel 1: Algemene bepalingen
De website van Tucho By Chocotale biedt haar klanten de mogelijkheid om de producten uit haar webwinkel online aan te kopen of te bestellen.
Onderhavige Algemene Voorwaarden ("Voorwaarden") zijn van toepassing op elke bestelling die geplaatst wordt door een bezoeker van deze website (“Klant”). Bij het plaatsen van een bestelling via de webwinkel van Tucho By Chocotale moet de Klant deze Voorwaarden uitdrukkelijk aanvaarden, waarmee hij instemt met de toepasselijkheid van deze Voorwaarden, met uitsluiting van alle andere voorwaarden. Bijkomende voorwaarden van de Klant worden uitgesloten, behoudens wanneer deze voorafgaandelijk, schriftelijk en uitdrukkelijk door Chocotale aanvaard zijn.
Vertalingen van deze algemene voorwaarden zijn beschikbaar in andere talen. Echter, alleen de Nederlandstalige versie is van toepassing; de andere vertalingen dienen slechts ter illustratie.
Artikel 2: Prijs
Alle vermelde prijzen zijn uitgedrukt in EURO, steeds inclusief BTW en alle andere verplicht door de Klant te dragen taksen of belastingen.
Indien leverings-, reservatie- of administratieve kosten worden aangerekend, wordt dit apart vermeld.
De opgave van prijs slaat uitsluitend op de artikelen zoals het woordelijk wordt omschreven. De bijhorende foto’s zijn decoratief bedoeld en kunnen elementen bevatten die niet inbegrepen zijn in de prijs.
Al onze prijzen kunnen op elk moment worden aangepast zonder voorafgaande kennisgeving. Bij eventuele fouten in onze prijzen zijn wij niet verplicht om de goederen tegen de foute prijs te leveren.
Artikel 3: Aanbod
Ondanks het feit dat de online catalogus en de website met de grootst mogelijke zorgvuldigheid worden samengesteld, is het toch mogelijk dat de aangeboden informatie onvolledig is, materiële fouten bevat, of niet up-to-date is. Kennelijke vergissingen of fouten in het aanbod binden Chocotale niet. Chocotale is in geen geval aansprakelijk ingeval van manifeste materiële fouten, zet- of drukfouten.
Wanneer de Klant specifieke vragen heeft over bv. maten, kleur, beschikbaarheid, leveringstermijn of leveringswijze, verzoeken wij de Klant om vooraf contact op te nemen via het emailadres info@tucho.be.
Het aanbod geldt steeds zolang de voorraad strekt en kan te allen tijde worden aangepast of ingetrokken . Chocotale kan niet aansprakelijk gesteld worden voor het niet beschikbaar zijn van een product. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
Artikel 4: Online aankopen
De bestelprocedure gebeurt door dat de klant artikel(en) aan het winkelwagen toevoegt. De klant kan naar de winkelwagen gaan om de toegevoegde artikel(en) te zien en de prijzen hiervan. Vervolgens dient de klant de persoonlijke gegevens in te vullen. Hierna kan de klant zien wat het totale bedrag is (incl. de verzendkosten). De klant dient akkoord te gaan met de algemene voorwaarden en het privacy beleid. Ook dient de klant een betalingsmethode te kiezen.
Chocotale is gerechtigd een bestelling te weigeren ingevolge een ernstige tekortkoming van de Klant met betrekking tot bestellingen waarbij de Klant betrokken is.
Artikel 5: Levering en uitvoering van de overeenkomst
Artikelen besteld via deze webwinkel worden geleverd in België, Nederland, Luxemburg, Duitsland en Frankrijk.
Elke zichtbare beschadiging en/of kwalitatieve tekortkoming van een artikel of andere tekortkoming bij de levering, moeten door de Klant onverwijld worden gemeld aan Chocotale binnen de 4 uur.
Het risico wegens verlies of beschadiging gaat over op de Klant vanaf hij (of een door hem aangewezen derde partij, die niet de vervoerder is) de goederen fysiek in bezit heeft gekregen. Het risico gaat echter al over op de Klant bij levering aan de vervoerder, als de vervoerder van de Klant de opdracht heeft gekregen de goederen te vervoeren en deze keuze niet door de verkoper (Chocotale) was geboden.
U bent verantwoordelijk voor het correct invullen van uw adres. Indien er problemen ontstaan door een foutief opgegeven adres, kunnen wij hiervoor niet aansprakelijk worden gesteld.
Wij behandelen elk pakket met de grootste zorg en aandacht. Om de chocoladeproducten goed te bewaren, maken wij gebruik van speciale dozen o.a. EPS-dozen, ice packs en speciale verzend- en opvulmateriaal. Mocht er desondanks problemen optreden, zoals het smelten van de chocolade tijdens het transport, dan kunnen wij hiervoor niet aansprakelijk worden gesteld.
Onze webshop richt zich op particuliere klanten. Daarom verstrekken wij geen BTW-facturen. Als u als Belgische onderneming een bestelling wilt plaatsen, kunt u contact met ons opnemen via e-mail op contact@tucho.be.
Artikel 6: Eigendomsvoorbehoud
De geleverde artikelen blijven tot op het moment van gehele betaling door de Klant, de exclusieve eigendom van Chocotale.
De Klant verbindt er zich toe zo nodig derden op het eigendomsvoorbehoud van Chocotale te wijzen, bv. aan eenieder die op de nog niet geheel betaalde artikelen beslag zou komen leggen.
Artikel 7: Herroepingsrecht en Annulering
De bepalingen van dit artikel gelden enkel voor Klanten die in hun hoedanigheid van consument artikelen online aankopen bij Chocotale
De Klant heeft het recht om binnen een termijn van 14 kalenderdagen zonder opgave van redenen de overeenkomst te herroepen.
De herroepingstermijn verstrijkt 14 kalenderdagen na de dag van levering.
Om het herroepingsrecht uit te oefenen, moet de Klant, Chocotale via een ondubbelzinnige verklaring, per mail (info@tucho.be), op de hoogte stellen van zijn beslissing de overeenkomst te herroepen.
Om de herroepingstermijn na te leven moet de Klant zijn mededeling betreffende zijn uitoefening van het herroepingsrecht verzenden voordat de herroepingstermijn is verstreken.
De Klant moet de goederen onverwijld, doch in ieder geval niet later dan 14 kalenderdagen na de dag waarop hij zijn beslissing om de overeenkomst te herroepen aan Chocotale heeft meegedeeld, terugzenden of overhandigen aan Chocotale te Leuvensestraat 18, 3200 Aarschot, België. De Klant is op tijd als hij de goederen terugstuurt voordat de termijn van 14 kalenderdagen is verstreken.
De directe kosten van het terugzenden van de goederen komen voor rekening van de Klant.
De Klant wordt verzocht de artikelen terug te sturen in hun oorspronkelijke staat en verpakking, met alle erbij geleverde accessoires, en gebruiksaanwijzingen. Indien het teruggestuurde product op een of andere manier in waarde verminderd is, behoudt Chocotale zich het recht voor om de Klant aansprakelijk te stellen en schadevergoeding te eisen voor elke waardevermindering van de goederen die het gevolg is van het gebruik van de goederen door de Klant dat verder gaat dan nodig is om de aard, de kenmerken en de werking van de goederen vast te stellen.
Alle teruggestuurde artikelen worden aandachtig onderzocht. Het uitgangspunt hierbij is dat de consument het artikel slechts mag inspecteren zoals hij dat in een winkel zou mogen doen. Teruggestuurde artikelen mogen niet gebruikt zijn. Wanneer een artikel een waardevermindering is ondergaan door het gebruik van de Klant zal dit ten laste van de Klant in rekening worden gebracht.
Eventuele extra kosten ten gevolge van de keuze van de Klant voor een andere wijze van levering dan de door Chocotale geboden goedkoopste standaard levering worden niet terugbetaald.
Chocotale betaalt de Klant terug met hetzelfde betaalmiddel als waarmee de Klant de oorspronkelijke transactie heeft verricht, tenzij de Klant uitdrukkelijk anderszins heeft ingestemd; in ieder geval zullen de Klant voor zulke terugbetaling geen kosten in rekening worden gebracht.
De Klant kan het herroepingsrecht niet uitoefenen voor:
- Voedingsmiddelen (desserts, chocolade producten, chocolade repen etc..)
- Afgeprijsde artikelen
U kunt een bestelling annuleren zolang het pakket nog niet is verzonden. Informeer ons zo snel mogelijk via e-mail op order@tucho.be. Zodra het pakket is verzonden, kunnen wij geen annuleringen meer accepteren. Voedingsproducten kunnen in geen geval worden geretourneerd. Bij annulering van een bestelling zijn wij genoodzaakt een annuleringsvergoeding van € 3 in rekening te brengen.
Artikel 8: Garantie
Krachtens de wet van 21 september 2004 betreffende de bescherming van de consumenten bij verkoop van consumptiegoederen heeft de consument wettelijke rechten. Deze wettelijke garantie geldt vanaf de datum van levering aan de eerste eigenaar. Elke commerciële garantie laat deze rechten onverminderd.
Om een beroep te doen op de garantie, moet de Klant een aankoopbewijs of bestelnummer kunnen voorleggen. Klanten wordt aangeraden om de oorspronkelijke verpakking van de goederen te bewaren.
Voor artikelen die online werden aangekocht en bij de Klant thuis zijn afgeleverd, dient de Klant contact op te nemen met Chocotale (info@tucho.be) en het artikel op zijn kosten terug te bezorgen aan Chocotale, Leuvensestraat 18, 3200 Aarschot, België.
Bij vaststelling van een gebrek moet de Klant Chocotale zo snel mogelijk inlichten. In ieder geval dient elk gebrek binnen een termijn van 2 maanden na vaststelling ervan door de Klant te worden gemeld. Nadien vervalt elk recht op herstelling of vervanging.
De (commerciële en/of wettelijke) garantie is nooit van toepassing op defecten die ontstaan ten gevolge van ongelukken, verwaarlozing, valpartijen, gebruik van het artikel in strijd met doel waarvoor het ontworpen werd, het niet naleven van de gebruiksinstructies of handleiding, aanpassingen of wijzigingen aan het artikel, hardhandig gebruik, slecht onderhoud, of elk ander abnormaal of incorrect gebruik.
Defecten die zich manifesteren na een periode van 6 maanden volgend op datum van aankoop, desgevallend levering, worden geacht geen verborgen gebreken te zijn, behoudens tegenbewijs door de Klant.
Artikel 9: Klantendienst
De klantendienst van Tucho By Chocotale is bereikbaar via e-mail op info@tucho.be of per post op het volgende adres Chocotale te Leuvensestraat 18, 3200 Aarschot, België. Eventuele klachten kunnen hieraan gericht worden.
Artikel 10: Geschillen en sancties voor niet-betaling
Onverminderd de uitoefening van andere rechten waarover Chocotale beschikt, is de Klant ingeval van niet- of laattijdige betaling vanaf de datum van de wanprestatie van rechtswege en zonder aanmaning een intrest van 10% per jaar verschuldigd op het niet-betaalde bedrag. Bovendien is de Klant van rechtswege en zonder aanmaning een forfaitaire schadeloosstelling verschuldigd van 10% op het betrokken bedrag, met een minimum van 25 euro per factuur.
Indien de Klant in gebreke blijft en na meerdere aanmaningen niet tot betaling overgaat, behoudt Chocotale zich het recht voor om een deurwaarder in te schakelen om de openstaande schuld te innen. In dat geval zullen alle deurwaarderskosten en bijkomende kosten die voortvloeien uit deze incassoactie voor rekening van de Klant zijn. Bovendien behoudt Chocotale het recht om de niet (volledig) betaalde artikelen terug te nemen.
Op deze algemene voorwaarden is het Belgisch recht van toepassing. In er geschillen ontstaan bij grensoverschrijdende verkopen zijn de rechtbanken van België bevoegd.
Artikel 11: Privacy
De verantwoordelijke voor de verwerking, Chocotale respecteert de Belgische wet van 8 december 1992 met betrekking tot de bescherming van het privéleven in de verwerking van de persoonlijke gegevens.
De door u meegedeelde persoonsgegevens zullen enkel gebruikt worden voor volgende doeleinden: het verwerken van uw bestelling, opmaken van het een factuur of bestelbon, voor het versturen van nieuwsbrieven en voor reclame- en/of marketingdoeleinden.
U beschikt over een wettelijk recht op inzage en eventuele correctie van uw persoonsgegevens. Mits bewijs van identiteit (kopie identiteitskaart) kunt u via een schriftelijke, gedateerde en ondertekende aanvraag aan Chocotale te Leuvensestraat 18, 3200 Aarschot, België of info@tucho.be, gratis de schriftelijke mededeling bekomen van uw persoonsgegevens. Indien nodig kunt u ook vragen de gegevens te corrigeren die onjuist, niet volledig of niet pertinent zouden zijn.
In geval van gebruik van gegevens voor direct marketing: U kan zich kosteloos verzetten tegen het gebruik van uw gegevens voor direct marketing. Hiertoe kan U zich steeds richten tot info@tucho.be.
Wij behandelen uw gegevens als vertrouwelijke informatie en zullen die niet doorgeven, verhuren of verkopen aan derden.
Chocotale houdt online (anonieme) bezoekersstatistieken bij om te kunnen bekijken welke pagina’s van de internetsite in welke mate bezocht worden.

Artikel 12: Gebruik van cookies
Tijdens een bezoek aan de site kunnen 'cookies' op de harde schijf van uw computer geplaatst worden. Een cookie is een tekstbestand dat door de server van een website in de browser van uw computer of op uw mobiel apparaat geplaatst wordt wanneer u een website raadpleegt. Cookies kunnen niet worden gebruikt om personen te identificeren, een cookie kan slechts een machine identificeren.
‘First party cookies’ zijn technische cookies die gebruikt worden door de bezochte site zelf en die tot doel hebben de site optimaal te laten functioneren. Bv: instellingen die de gebruiker bij de vorige bezoeken aan de site heeft gedaan, of nog : een vooraf ingevuld formulier met data dat de gebruiker tijdens vorige bezoeken heeft gedaan.
‘Third Party cookies’ zijn cookies die niet afkomstig zijn van de website zelf, maar wel van derden, bv. een aanwezige marketing of advertentieplug-in. Bv. cookies van Facebook of Google Analytics. Voor dergelijke cookies moet de bezoeker van de site eerst toestemming geven – dit kan gebeuren via een balk onderaan of bovenaan de website, met verwijzing naar deze policy, die het verder surfen op de website echter niet verhindert.

Artikel 13: Aantasting geldigheid - niet-verzaking
Indien een bepaling van deze Voorwaarden ongeldig, onwettig of nietig wordt verklaard, zal dit op geen enkele wijze de geldigheid, de wettigheid en de toepasbaarheid van de andere bepalingen aantasten.
Het nalaten op gelijk welk moment door Chocotale om één van de in deze Voorwaarden opgesomde rechten af te dwingen, of gelijk welk recht hiervan uit te oefenen, zal nooit gezien worden als een verzaking aan zulke bepaling en zal nooit de geldigheid van deze rechten aantasten.
Artikel 14: Wijziging voorwaarden
Deze Voorwaarden worden aangevuld door andere voorwaarden waar expliciet naar verwezen wordt, en de algemene verkoopsvoorwaarden van Chocotale. Ingeval van tegenstrijdigheid, primeren onderhavige Voorwaarden.
Artikel 15 : Website
Wij zijn niet aansprakelijk voor schade door inbraak of hacking van de website of schade door phising, farming of andere vormen van internetfraude of andere criminele activiteiten.
Wij zijn niet verantwoordelijk voor technische fouten op onze website. Eventuele bugs of fouten kunnen ertoe leiden dat verzendkosten of verpakkingskosten niet correct worden aangerekend. Indien een prijs foutief wordt weergegeven, zijn wij niet verplicht om het product aan die foutieve prijs te verkopen.

Article 1: General provisions
The Tucho By Chocotale website offers its customers the opportunity to purchase or order products from its online store online.
These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this website ("Customer"). When placing an order via the Tucho By Chocotale online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other terms and conditions. Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other duties or taxes required to be paid by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
All our prices are subject to change at any time without notice. In the event of any errors in our prices, we are not obliged to deliver the goods at the incorrect price.
Article 3: Offer
Despite the fact that the online catalog and the website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer do not bind Chocotale. Chocotale is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact us in advance via the email address info@tucho.be.
The offer is valid while supplies last and can be adjusted or withdrawn at any time. Chocotale cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.
Article 4: Online purchases
The ordering procedure is done by the customer adding item(s) to the shopping cart. The customer can go to the shopping cart to see the added item(s) and their prices. The customer must then fill in the personal information. After this, the customer can see the total amount (including shipping costs). The customer must agree to the general terms and conditions and the privacy policy. The customer must also choose a payment method.
Chocotale is entitled to refuse an order due to a serious shortcoming by the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
Items ordered through this online store are delivered in Belgium, the Netherlands, Luxembourg, Germany and France.
Any visible damage and/or qualitative shortcoming of an item or other shortcoming in delivery must be reported by the Customer immediately to Chocotale within 4 hours.
The risk of loss or damage passes to the Customer once he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by the seller (Chocotale).
You are responsible for entering your address correctly. If problems arise due to an incorrectly specified address, we cannot be held liable for this.
We treat every package with the utmost care and attention. To properly store the chocolate products, we use special boxes, including EPS boxes, ice packs and special shipping and filling materials. If problems nevertheless occur, such as the chocolate melting during transport, we cannot be held liable for this.
Our webshop focuses on private customers. That is why we do not issue VAT invoices. If you, as a Belgian company, would like to place an order, you can contact us by email at contact@tucho.be.
Article 6: Retention of title
The delivered items remain the exclusive property of Chocotale until full payment has been made by the Customer.
If necessary, the Customer undertakes to inform third parties of Chocotale's retention of title, for example to anyone who would seize items that have not yet been fully paid for.
Article 7: Right of withdrawal and Cancellation
The provisions of this article only apply to Customers who purchase items online from Chocotale in their capacity as consumers
The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day of delivery.
To exercise the right of withdrawal, the Customer must inform Chocotale by an unequivocal statement by email (info@tucho.be) of his decision to withdraw from the agreement.
To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Chocotale at Leuvensestraat 18, 3200 Aarschot, Belgium without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Chocotale. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods will be borne by the Customer.
The Customer is requested to return the items in their original condition and packaging, with all accessories supplied and instructions for use. If the returned product has been reduced in value in any way, Chocotale reserves the right to hold the Customer liable and claim compensation for any reduction in value of the goods resulting from the use of the goods by the Customer. goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.
All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would in a store. Returned items must not have been used. If an item has suffered a reduction in value due to the use of the Customer, this will be charged to the Customer.
Any additional costs resulting from the Customer's choice of a different method of delivery than the cheapest standard delivery offered by Chocotale will not be refunded.
Chocotale will reimburse the Customer using the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement.
The Customer cannot exercise the right of withdrawal for:
- Foods (desserts, chocolate products, chocolate bars, etc.)
- Discounted items
You can cancel an order as long as the package has not yet been shipped. Please inform us as soon as possible via email at order@tucho.be. Once the package has been shipped, we can no longer accept cancellations. Food products cannot be returned under any circumstances. If you wish to cancel an order, we are obliged to charge a cancellation fee of €3.
Article 8: Warranty
Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
To invoke the warranty, the Customer must be able to provide proof of purchase or order number. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact Chocotale (info@tucho.be) and return the item at his expense to Chocotale, Leuvensestraat 18, 3200 Aarschot, Belgium.
If a defect is discovered, the Customer must inform Chocotale as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. Afterwards, any right to repair or replacement expires.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless the Customer proves otherwise.

Article 10: Disputes and sanctions for non-payment
Without prejudice to the exercise of other rights available to Chocotale, in the event of non-payment or late payment, the Customer is legally liable to pay interest of 10% per year on the unpaid amount from the date of the default and without notice. In addition, the Customer is legally liable and without notice to pay a lump sum compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.
If the Customer remains in default and does not pay after several reminders, Chocotale reserves the right to engage a bailiff to collect the outstanding debt. In that case, all bailiff costs and additional costs arising from this collection action will be borne by the Customer. In addition, Chocotale reserves the right to take back items that have not been (fully) paid for.
Belgian law applies to these general terms and conditions. In disputes arising from cross-border sales, the courts of Belgium have jurisdiction.
Article 11: Privacy
The controller, Chocotale, respects the Belgian law of December 8, 1992 regarding the protection of private life in the processing of personal data.
